Terms and conditions

This Terms and Conditions document should be read in conjunction with the following important policies:   

 

Updates  

  1. We may change and/or update our Terms and Conditions by uploading a revised document onto our website.  The changes will apply from the date that we upload the revised document 

  

Ordering of items 

  1. Orders will only be deemed valid when placed through correct use of the Website. Please allow 1 – 5 days to process the order and a further 1-5 days for delivery of the order.

  1. All sales are subject to the Terms and Conditions of LIT Computers, as displayed on the Website, as well as any supporting policies that may apply including the Privacy Policy and the Refund Policy.

  1. It is the customer’s responsibility to ensure that all their details reflect correctly on our Website, including (but not limited to) contact details and delivery address. We cannot be held liable for any loss suffered by the customer as a result of incorrect information provided.

  1. LIT Computers reserves the right to cancel any order for which payment has already been received at any point until the items have been delivered to the customer. This may occur, for example, if stock is insufficient, if the necessary items cannot be procured in a timely manner, or if the quality of goods ordered does not meet our quality standards.  Should we exercise this right, the customer will be refunded accordingly within 7 working days.   

 

Payment terms 

  1. Items will only be dispatched once full payment is received and cleared in our bank account. 

  2.  

Prices 

  1. Prices may change at short notice, due to various factors such as currency fluctuations and information provided by suppliers. 

  1. All errors and omissions are excluded. Should any errors or omissions occur, LIT Computers reserves the right to cancel the affected order(s) and refund the customer in accordance. 

 

STOCK 

  1. Our stock availability is dependent on the stock levels of our suppliers.   There may be minor variations on the specification advertised due to changes from the manufacturer. Please ensure that any items ordered from LIT Computers are fit for its intended purpose, since we cannot be held liable if they are not suitable for its intended purpose.

  1. Customers will be notified of the estimated delivery date of their order. Any delay in the estimated delivery date will be communicated accordingly. LIT Computers cannot be held liable for any delays beyond our control, such as delays by the manufacturer, supplier, and/or courier company. 

  2.  

  3. Should the couriers be unable to deliver the order (e.g. if the customer was not available to accept the delivery or an incorrect delivery address was provided by the customer), LIT Computers reserves the right to: store the items at the customer’s expense which may include insurance cover for the duration of storage; and/or 

  1. It is the customer’s responsibility to ensure that the delivered item(s) match the item(s) ordered and that there is no damage to the package on arrival. Please contact us immediately via [email protected], should you receive a wrong or damaged package(s) or item(s).  

 

Product specifications

  1. There may be minor variations on the specification advertised due to changes from the manufacturer. 

  1. Products and prices listed on our Website may change at any time, at LIT Computers’ sole discretion and without prior notice. 

  1. Please ensure that any items ordered from LIT Computers are fit for its intended purpose, since we cannot be held liable if they are not suitable for its intended purpose. 

 

Shipping of items

  1. Please allow 1 – 5 working days to process the order and a further 1 – 5 working days for delivery of the order. Please expect an email once the order is processed and on the way. Customers will be notified of the estimated delivery date of their order. Any delay in the estimated delivery date will be communicated accordingly. LIT Computers cannot be held liable for any delays beyond our control, such as delays by the manufacturer, supplier, and/or courier company.

  1. Should delivery delays be experienced in excess of 15 working days, the order may be cancelled and the customer will be refunded within 7 working days.   

  1. Should the couriers be unable to deliver the order (e.g. if the customer was not available to accept the delivery or an incorrect delivery address was provided by the customer), LIT Computers reserves the right to: 

  • re-arrange delivery at the customer’s expense 
  • store the items at the customer’s expense which may include insurance cover for the duration of storage; and/or 
  • cancel the order.   
  1. It is the customer’s responsibility to ensure that the delivered item(s) match the item(s) ordered and that there is no damage to the package on arrival. Please contact us immediately via [email protected], should you receive a wrong or damaged package(s) or item(s).  

  1. Once the items are delivered to the customer, ownership and risk is transferred to the customer and therefore no longer resides with LIT Computers. 

  2. Shipping cost is charged at a flat rate and will change from tome to time. The rate will be displayed and added at the Checkout page.

 

 

Usage of Website  

  1. You may not use, replicate or reproduce our Website (or any part thereof), or any content from our Website, for personal gain or for commercial purposes. 

  1. Any user is required to be 18 years or older and legally able to transact complete agreements. Our services are not meant to be used by children under the age of 18. We do not knowingly process any personal information of children under the age of 18. Should we become aware that a child under the age of 18 has provided us with personal information, we will delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to take the necessary action. 

  1. Security standards have been applied to secure the Website and its content, however, security cannot be ensured. 

  1. Use of our Website is entirely at the user’s own risk. 

 

Liability 

  1. Users and customers agree to keep LIT Computers indemnified, and to hold LIT Computers harmless against all loss or damage which the customer may sustain from any cause arising. 

  1. LIT Computers are not liable for any direct or indirect damage or loss (including but not limited to loss of business, loss of profits, loss of data, any other financial losses, injury or death) resulting from any cause, including but not limited to: 

  • Use of our websites; 
  • Any content, downloadable content, or services on our Website; 
  • Any security breaches that may occur on our Website; 
  • Use of any external links to third party websites; and 
  • The use of any of our products; 
  
  1. Our liability is limited to the invoiced amount charged and paid by the customer in respect of the relevant item within the specified warranty period. 

 

Force Majeure 

  1. In the event that LIT Computers is unable to fulfil our contractual obligation due to circumstances beyond our control (including but not limited to natural disasters, fire, flood, industrial action by third parties and so forth), LIT Computers are not in breach of contract, and will use reasonable efforts to fulfil the order as soon as practically possible, failing which the order(s) will be cancelled and the invoiced amount charged and paid by the customer in respect of the relevant item will be refunded to the customer.  

 

Partial invalidity  

  1. Each term and condition contained in this document (and supporting policies such as our Privacy Policy and Refund Policy) is separate from the other terms and conditions in the sense that if anyone is determined to be illegal and unenforceable, it will simply be disregarded and of no force and effect, but the agreement will otherwise remain valid. 

Governing laws 

  1. This Terms and Conditions (and all associated policies such as the Privacy Policy and Refunds policy) will in all aspects be interpreted and governed by the laws of the Republic of South Africa. 

Definitions 

  • “LIT Computers”, “we”, “us”: LIT Computers 
  • “Items”: The products offered by LIT Computers. 
  • “User”: Any person(s) browsing any page (or part thereof) of the Website.  
  • “Customer”: Any person(s) buying items from LIT Computers.
